Terms and conditions for the sale and purchase of tours, expeditions and camps

1. VALIDITY

These terms and conditions apply to all orders unless another written agreement has been entered into.

2. ORDERING/PRICES

Bookings for our tours can be made via your travel agency/agent, via our website or in writing to our email address. Special registration forms for our overnight tours will be sent. Arrivals after the start of the event, and departures that may occur before its end, do not entitle you to reductions in the tour price, unless this has been agreed in writing or stated in advance. Nor will a reduction in price be given for circumstances beyond our control such as weather, wind and flight or boat delays, changed ice conditions, etc. See point 5.

3. PAYMENT AND CANCELLATION POLICY

Guests are required to make a 30% deposit at the time of booking. The remaining balance must be paid in full no later than 45 days before the scheduled trip.

Cancellations made 45 days or more before the trip will incur a 30% cancellation fee.

Cancellations made 44 days or less before the trip will incur a 100% cancellation fee.

5. UNEXPECTED EVENTS

Svalbard Wildlife Expeditions AS reserves the right to change departure times, minimum numbers or cancel trips up to 4 weeks before departure (day trips until the start of the trip) if there are too few participants in relation to the number stated in brochures or on the website. We also reserve the right to cancel trips right up to the start of the trip due to force majeure or other events that are beyond the company's control and that prevent the trip from being carried out.

Svalbard Wildlife Expeditions AS also has the right to terminate agreements with customers if the customer's physical and mental condition, or the guest's clothing in relation to the content of the trip is considered incompatible. This also applies if the customer cannot communicate (speak and understand) English.

In such cases, Svalbard Wildlife Expeditions AS will have the right to terminate the agreement and will not be liable for compensation beyond the amount that the customer has already paid the operator.

We also reserve the right to change the program along the way, if the organizer/guide deems it necessary for safety or technical reasons (weather conditions, scooter breakdown, delays, etc.). In the Arctic, the weather is the deciding factor, and the extreme conditions that prevail may in some cases result in the program having to be changed (also due to ongoing rescue operations) and thus do not entitle you to a reduction in price. This also applies if the program has to be changed to protect wildlife and/or to follow local guidelines.

No refunds for lost driver's license or delayed/cancelled flights.

Scooter insurance included, where applicable, and the deductible is NOK 10,000.

Svalbard Wildlife Expeditions AS tries as far as is reasonable to carry out the trip as described. The guest's safety will always be the first priority.

6. CUSTOMER RESPONSIBILITIES

The customer is responsible for assessing their own physical and mental fitness in relation to the content of the tour, and ensuring that they are properly dressed and equipped for the tour. The customer must at all times comply with the instructions given by the company/guide. It is not permitted to bring private weapons or pyrotechnic equipment on our tours under any circumstances, and local requirements for flying drones must be complied with.

Svalbard Wildlife Expeditions AS reserves the right to refuse participation in our activities if they are considered a risk to safety, act in a manner that is a nuisance to the guide or other participants on the tour, or are not properly equipped/dressed. Intoxicated persons are not allowed.

Safety is always our top priority and it is important that our guide can give instructions and make himself understood. Therefore, it is mandatory to understand and speak English to participate in our tours. The tour will be conducted in English.

7. INSURANCE

Svalbard Wildlife Expeditions AS activities are covered by liability insurance with our insurance company. We have also provided a guarantee to the Governor of Svalbard for expenses in connection with any rescue operations in Svalbard. Svalbard Wildlife Expeditions cannot be held liable for damage or loss that occurs beyond our control. For participation in our longer trips, we require that each participant has taken out individual travel insurance. This can be purchased through a travel agency or personal insurance company.

8. PACKAGE TRAVEL ACT

This offer is subject to the Package Travel Act of 25 August 1995 No. 57 and Svalbard Wildlife Expeditions AS is the supplier of this package within the meaning of the Act. As a member of the Norwegian Travel Industry Association, a guarantee has also been provided to the Travel Guarantee Fund in accordance with the Package Travel Act.

9. TYPOGRAPHICAL ERRORS AND PRICE CHANGES

Svalbard Wildlife Expeditions AS reserves the right to printing errors and price changes beyond our control.

11. USE OF IMAGES FOR MARKETING PURPOSES

By accepting our terms and conditions, you grant Svalbard Wildlife Expeditions the right to photograph/film you/your guests and use your image, photograph or silhouette in connection with exhibitions, advertising and/or publicity.

You/Guests will not bring or maintain any claim, action or demand of any kind against Svalbard Wildlife Expeditions, including, but not limited to, claims based on breach of privacy.
