BOOKING TERMS AND CONDITIONS OVERVIEW FOR TRIPS OUTSIDE THE UK

By booking an overnight trip in Europe with us you agree to the following terms and conditions and those of the trip provider, given at the time of booking. 

CANCELLATION FEES

We understand that things crop up and you may need to cancel: 

Due to the limited number of spots available, we ask that you book in only if you can make your chosen date. Booking and then canceling means others will miss out on the opportunity to join.

The cancellation will only be effective from the date that the cancellation is received in writing by email. Cancellation charges will be payable as follows:

  • Cancellation fee of 100% is charged if cancelled 44 days or less before the trip

  • Cancellation fee of 30% is charged if cancelled 45 days or more before the trip

CANCELLATIONS DUE TO COVID

If you are unable to attend because you have tested positive, our normal cancellation policies apply as above. 

You are strongly advised to have the appropriate travel insurance at the time of booking.

Refunds are not available in all instances of cancellation due to injury or illness including Covid-19.

RESCHEDULING

We do not offer rescheduling on our European trips. If you are unable to attend the date you booked, you will need to cancel your booking. Cancellation will only be effective from the date that the cancellation is received in writing by email. Cancellation charges will be payable as follows:

  • Cancellation fee of 100% is charged if canceled 44 days or less before the trip

  • Cancellation fee of 30% is charged if canceled 45 days or more before the trip

INSURANCE

We recommend all guests have appropriate travel insurance that protects them for cancellation and Covid-19.  We can't advise on insurance, but you'll find lots of information here: https://www.moneysavingexpert.com/insurance/uk-travel-insurance/

CANCELLATIONS BY US

Minimum numbers

Each trip has a set minimum number, you’ll find this on the booking page of your trip. Our trips are normally fully booked, however if we do not reach minimum numbers we may be required to cancel your trip.

If we do not meet the minimum numbers 14 days before the start of your trip, we will cancel your trip and refund your booking. 

If we are required to cancel we will not be responsible for any costs incurred from travel arrangements, accommodation etc. We recommend that you book flexible travel options and have appropriate travel insurance. 

Adverse Weather

With all adventures, we need to remain flexible and adaptable. We will strive to stick to our itineraries provided at the time of booking, however we may be required to make changes to the itinerary to accommodate the weather conditions. No refunds or rescheduling will be offered for changes to the itinerary.

If we are required to cancel your trip due to adverse and unsafe weather conditions, we will reschedule your trip for a later date or convert your booking to credit, valid until December 2022. 

If we are required to cancel due to weather, we will not be responsible for any costs incurred from travel arrangements, other accommodation etc. We recommend that you book flexible travel options and have appropriate travel insurance. 

OVERVIEW

Bookings from 1st January 2022

Gutsy Girls Ltd act as a Travel Agent and Events Organiser to connect likeminded women, through events, weekend retreats and holidays.

We work with Suppliers/Principals including instructors, activity providers, accommodation providers, tour operators and travel providers to run trips that connects solo travellers.

Your contract is with Gutsy Girls Ltd, registered office 25 Lemon Street, Truro, United Kingdom, TR1 2LS, company number 12288619

Your contract incorporates these Booking Conditions and by making a booking with us you confirm your acceptance of these Booking Conditions.

Gutsy Girls Events are run by activity centres, providers and instructors.

When booking through Gutsy Girls Ltd you agree to the Terms and Conditions set by the Supplier/Principal/Provider and Gutsy Girls Ltd.

If you have booked a trip before January 2022, please ask us for a copy of our Terms and Conditions.

Gutsy Girls Ltd is a fully insured Travel agency, we work with “Supplier(s)” “Principal(s)” that meet the 1992 EC Package Travel Regulations and offer our clients Insolvency Protection for your booking. Further details of this will be provided at the time of booking.

BOOKING TERMS AND CONDITIONS FOR WEEKEND RETREATS AND HOLIDAYS

DEFINITIONS

a) References within the Booking Conditions to “Travel Arrangements” are to the accommodation, transport, activities, excursions and other services we feature on our website.

b) References to “Supplier(s)” “Principal(s)” mean the principal of your travel arrangements/trip.

c) The references to “You” and “Your” means the persons named in the booking (including any person or persons added or substituted subsequently).

d) References to “We” “Us” and “Our” means Gutsy Girls Ltd.

e) References to “GG Events” means the day events in London, including paddleboarding and skateboarding.

f) References to “Trip” “Trips” mean the trips listed on our website as weekend retreats and holidays.

g) References to “Provider” means the activity provider for our “GG Events”

h) References to “Booking Conditions” means the terms and conditions set by the Supplier/Principal.

i) References to “Gutsy Girls” means Gutsy Girls Ltd.

1 YOUR BOOKING

1.1 We act only as an agent in respect of all weekend retreats and holiday bookings we take and/or make on your behalf

1.2 When booking a weekend retreat or holiday through us you agree to our Terms and Conditions and those set by the Supplier/Principal.

1.3 When booking, you enter into a booking contract between yourself and the Supplier/Principal. It is your responsibility to check the booking conditions of the Supplier/Principal before entering into an agreement.

1.4 When you make your booking you agree that you have authority to accept and do accept on behalf of the party named in your booking, the terms of our Terms and Conditions and the Booking Conditions of the Supplier/Principal.

1.5 The person making the booking must be at least 18 years of age and authorised to do so by all persons named in the booking.

1.6 You are responsible for making all payments due to us under your booking. All party members named within the booking are jointly and severally liable for all payments due under the booking.

1.7 A booking contract will exist as soon as we issue you an Booking Invoice.

1.8 We do not accept any liability if we are not notified of any inaccuracies within 7 days of issue of the Booking Confirmation Invoice to you. Once you have received your Booking Invoice please check this carefully. If any of the information contained within the Booking Invoice is incorrect or incomplete, please notify us immediately in writing as it may not be possible to make later changes to it.

1.7 We reserve the right to refuse to accept bookings at our absolute discretion without stating the reason for doing so.

1.8 You agree that Gutsy Girls is not responsible for any terms, conditions, warranties or representation associated with the Suppliers/Principals. While the utmost care is always taken to ensure you receive the best service from our selected Suppliers/Principals, your booking contract is between you and the Supplier/Principal of your trip.

1.9 You agree not to hold Gutsy Girls responsible or for any inconveniences, financial losses, injury from the Weekend Retreats or Holiday. We strongly recommend you take out comprehensive travel insurance at the time of booking a weekend retreat or holiday.

1.10 Gutsy Girl works with Suppliers/Principals to offer exclusive trip dates, available only to Gutsy Gutsy clients. Gutsy Girls may also advertise trips that are not exclusive to Gutsy Girls clients. These are bound to our terms and conditions set by us and the Supplier/Principal. If you are booking a non-exclusive Gutsy Girls trip you will be informed at the time of booking.

2 SPECIAL REQUESTS

Special requests must be made at the time of booking. We cannot guarantee that the request will be met and any failure to do so will not be a breach of contract on our part, or the Supplier/Principal. Confirmation that a request has been made will be included on your Booking Invoice or upon the acknowledgement of booking. We are unable to accept bookings which are conditional upon a special request being met and these will be treated by us as a standard booking.

3 PAYMENTS

3.1 In order to book your chosen trip, you must pay the required deposit at the time of booking. This will vary depending on the Supplier/Principal. We will inform you of your payment terms at the time of booking.

3.2 Your booking is not confirmed until we receive payment of your deposit and you have received confirmation from us. Our trips have limited availability so early booking is advised to avoid disappointment. We advise you not to book any travel arrangements until your trip has been confirmed by us.

3.3 You must pay the full balance by the due date set at the time of booking. If full payment is not received by the balance due date, we will inform the Supplier/Principal(s) who may cancel your booking and charge the applicable cancellation fees (as set out in the Supplier/Principal’s terms and conditions).

3.4 Except where otherwise advised or stated in the terms and conditions of the Supplier/Principal concerned, all monies you pay to us for Travel Arrangements/Trips will be held by us on behalf of the Supplier/Principal until we make payment to the Supplier/Principal in accordance with our agreement with the Supplier/Principal.

3.5 Some Suppliers/Principals will take direct payments from you, our terms and conditions will still apply, along with the booking conditions of the Supplier/Principal.

3 HOLIDAY PRICE

3.1 We reserve the right to alter the prices of any of the holidays shown on our website. You will be advised of the current price of the trip you wish to book before your contract is confirmed.

3.2 Prices are subject to currency conversion rates, the final balance payable will be based on the currency conversion rate at the time your final payment.

4 TRIP CHANGES OR CANCELLATIONS BY YOU

4.1 If you need to cancel your trip, you must send us the details by email to bookings@gutsygirls.co.uk

4.2 Changes and cancellations by you may be subject to cancellation/amendment fees and/or non-refundable deposits and some Suppliers/Principals do not allow changes and therefore full cancellation charges will apply. These will be outlined in the terms and conditions of the Supplier/Principal.

4.3 Gutsy Girls reserves the right to charge an administration fee of £65 for any amendments to your booking.

4.4 Gutsy Girls will charge the cancellation fee of 100% of trip cost is charged if canceled 44 days or less before the trip start date. Cancellation fee of 30% of full trip cost is charged if canceled 45 days or more before the trip

5 TRIP CANCELLATIONS BY SUPPLIER/PRINCIPAL

5.1 Suppliers/Principals retain the right to cancel trips or make changes to the trip. These will be set out by the booking conditions of the Supplier/Principal

5.2 Compensation and refunds on your trip will be set out by the booking conditions of the Supplier/Principal.

5.3 We recommend that you take out appropriate travel insurance at the time of booking to cover you in the case of cancellation by the Supplier/Principal.

5.4 We will contact you as soon as reasonably possible to offer alternative dates and arrangements.

5.5 We will liaise between you and the Supplier/Principal in relation to any alternative travel arrangements offered by the Supplier/Principal but we will have no further liability to you.

6 TRIP CANCELLATION BY GUTSY GIRLS

6.1 Some trips will be subject to group size minimum in order to run, and therefore occasionally have to be cancelled if this is the case we will inform you at the time of booking.

6.2 You agree not to hold us responsible or for any inconveniences or financial losses from any trip cancelled by Gutsy Girls when you were informed of group size minimum at the time of booking. We ask that you do not book any travel arrangements until we have confirmed that your trip has reached the group size minimum to run.

7 COMPLAINTS

7.1 The contract for your trip is between you and the Supplier/Principal, any queries or concerns about your trip, should be addressed to them in the first instance. Many Suppliers/Principals will have their complaint procedure within their booking conditions.

7.2 If you have a problem with your trip whilst on the trip, this must be reported to the Supplier/Principal immediately. If you fail to follow this procedure there will be less opportunity for the Supplier/Principal to investigate and rectify your complaint. The amount of compensation you may be entitled to may therefore be reduced or extinguished as a result.

7.3 If you wish to complain when you return home, write to the Supplier/Principal, we will provide their contact details.

7.4 If you remain unsatisfied, please contact us via email natalie@gutsygirls.co.uk as soon as possible, within 28 days of your return to the UK whereby we will endeavour to assist in our capacity as an agent by liaising with the Supplier/Principal on your behalf.

8 OUR LIABILITY TO YOU

8.1 Your booking contract is between you and the Supplier/Principal, you agree to the terms and conditions of the Supplier/Principal at the time of booking. As the Agent, we accept no responsibility for the actual provision of the trip.

8.2 We accept no responsibility for any information about the trip that we pass on to you in good faith. However, in the event that we are found liable to you on any basis whatsoever, our maximum liability to you is limited to twice the cost of the commission we earn on your booking (or the appropriate proportion of this if not everyone on the booking is affected).

9. FORCE MAJEURE

Except where otherwise expressly stated in these Booking Conditions we will not be liable or pay you compensation if our contractual obligations to you are affected by “Force Majeure”.

Force Majeure means any event beyond our the Supplier’s control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include warfare and acts of terrorism (and threat thereof), civil strife, significant risks to human health such as the outbreak of serious disease at the travel destination or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the travel destination or remain at the travel destination, the act of any government or other national or local authority including port or river authorities, industrial dispute, labour strikes, lock closure, natural or nuclear disaster, fire, chemical or biological disaster, unavoidable technical problems with transport and all similar events outside our or the Supplier(s) concerned’s control.

10 HEALTH REQUIREMENTS

10.1 You must provide us with full details of any existing medical condition or disability that may affect your trip (including, in particular, any accommodation requirements) at the time of your booking.

10.2 If in our reasonable opinion your chosen holiday arrangements are not suitable for your medical problem or disability or you are not travelling with someone who can provide all assistance you may reasonably require, we have the right to refuse to accept the booking.

10.3 If you do not give us full details of your medical problem or disability we can also cancel the booking when we find out full details if in our reasonable opinion, the holiday arrangements are not suitable or you are not travelling with someone who can provide all assistance reasonably required.
11 INSURANCE

11.1 Taking part in activities, adventure sports, action sports carries a high risk of damage, personal injury or death. We do not accept or assume any responsibility or liability for accidents, injuries or even death occurred while taking part in any trip.

11.2 The Supplier/Principal terms and conditions will have details regarding liability.

11.3 You must take out suitable insurance for all your needs before you travel. We cannot be held responsible for any costs you may incur as a result of failing to do so.

11.4 If you take part in activities whilst on holiday that have been organised and arranged independently of us, participation is at your own risk and it is your responsibility to ensure that you have obtained the relevant insurance.

12 YOUR RESPONSIBILITIES AND BEHAVIOUR WHILST ON HOLIDAY

12.1 As part of your booking with us, you are accepting liability for any loss or damage caused by you or any member of your party during the course of your holiday. Payment for any loss or damage must be made to us or our Supplier/Principal at the time that it occurs or as soon as is reasonably practicable thereafter.

12.2 If the cost of the loss or damage is not known at the time, we will reasonably estimate it and if this reasonable estimate exceeds the amount paid, you must pay the difference once known, and if it is less, the difference will be refunded to you. You will also be responsible for, and agree to indemnify us, in respect of any claim subsequently made against us and all costs incurred by us (including our own and any other party’s full legal costs) arising from your actions.

12.3 You are also responsible for the behaviour of yourself and other members of your party. We can refuse to accept you as a customer or refuse to continue dealing with you and/or any other member of your party by terminating your holiday arrangements if yours or their behaviour is or is likely to be, in our reasonable opinion or in the reasonable opinion of our Suppliers/Principal, disruptive, upsetting or dangerous to yourself or anyone else, or if you or any member of your party have caused or are likely to cause damage to property. In these circumstances, we will not pay any refund, compensation or other sum whatsoever or any costs or expenses incurred by you if we have to terminate your travel arrangements due to such unacceptable behaviour. In this situation we will have no further responsibility for you or any other member of your party (including any return travel arrangements).

12.3 We cannot be held responsible for the actions or behaviour of other guests one the trip.

13 EXCURSIONS AND ACTIVITIES AND RESORT INFORMATION

Excursions, tours or other activities that you book or pay for whilst on your trip do not form part of the trip provided by us or the Supplier/Provider. Your contract will be with the operator or provider of that excursion, tour or activity and not with us. We are not responsible for the provision of the excursion, tour or activity or anything that may happen during the course of its provision by the operator. We do not accept any liability in relation to any such excursion, tour or activity and these Booking Conditions do not apply to them.

14 OUR WEBSITE AND ADVERTISING

The information contained in our website and advertising material is our responsibility and to the best of our knowledge and belief it is correct at the time of publication. Occasionally errors may occur and information may change and you must therefore check all the details of your travel arrangements at the time of booking.

15 TRAVELLING TO YOUR TRIP

15.1 We are not responsible for how you arrive at the starting point or trip location. We will provide information regarding how to get there, however it is your responsibility to research and make your own travel arrangements.

15.2 With your permission we will connect you with other guests joining your trip, to see if you can arrange your travel together. You take full responsibility for your own travel plans.

15.3 If you choose to share cars with other guests whilst on a trip, Gutsy Girls is in no way responsible for any risk, injury or death occurred through car sharing.

16 DATA PROTECTION

Information about you or members of your party, including your names, contact and details and any special needs, disabilities, dietary requirements collected by us when you request information or making a booking with us. We may disclose this information to our service for the purpose of providing you with your holiday arrangements. Only information necessary for this purpose will be disclosed to them. On occasions, it may be mandatory for us to disclose information for security and terrorism purposes and any other purpose imposed upon us by governments or other regulatory authorities. We may use your information for the purposes set out in our Data Protection Registration with the Office of the Information Commissioner. We may disclose this information to companies which act as data processors on our behalf. Some information, for example relating to your religion or health, may be “sensitive personal data” within the meaning of the Data Protection Act 1998. We need this information to cater for your needs, but it is collected on condition that we have your positive consent. If you do not agree with our use of your information, we cannot accept your booking. By making a booking with us, you agree to allow your insurers, their agents and medical staff to disclose relevant information to us in circumstances where we may need to act in the interests of everyone in the group with whom you are travelling.

LAW AND JURISDICTION

These Booking Terms and Conditions are governed by English Law with any action arising out of it being subject to the exclusive jurisdiction of the courts of England and Wales.
